Fives Terms of Use
Fives is published by Nasahsirah Tech, LLC, a Georgia (USA) limited liability company ("we", "us"). By playing Fives you agree to these terms. If you do not agree, please do not use the game.
1. The game
Fives is a card game played for entertainment. Practice games against the computer never change your chips. Online games use chips according to the rules shown in the app.
2. Chips are not money
Chips, whether earned or bought, are a limited licence to use a feature of the game. They have no cash value, are not your property, and cannot be cashed out, sold, transferred or exchanged for money, prizes or anything of value. Fives is not gambling. Chip purchases are final except where the law or the app store's refund policy says otherwise; refunds are handled by Apple or Google. We may remove chips that were obtained through errors, fraud, chargebacks or abuse.
2a. Memberships
Fives Plus ($3.99 a year) and Fives Premium ($9.99 a year) are auto-renewing subscriptions bought through the App Store or Google Play. Each removes ads, adds chips every 30 days while it is active (50,000 for Plus, 100,000 for Premium) and unlocks the members' card backs. A membership renews every year at the price shown unless you cancel it in your App Store or Google Play subscription settings at least 24 hours before the renewal date. Payment is charged by Apple or Google; refunds follow their policies. When a membership ends, monthly chips stop and ads return; chips already given are kept, and like all chips they have no cash value.
3. Your account
A guest account is tied to your device; sign in with Apple, Google, Facebook or an email code to keep it safe. You are responsible for activity on your account. You may delete your account at any time in Settings › Account.
4. Fair play and conduct
Do not cheat, use bots or automation, exploit bugs, collude with other players, or interfere with the service. In chat, do not harass, threaten, or share hateful, sexual, or illegal content or personal information. You can block players and report messages; we review reports and may mute, suspend or close accounts that break these rules, and remove the chips involved.
5. Online games
Leaving a Showdown game, or running out of time repeatedly, forfeits it as described in the app. Network problems on your side are part of play; we do our best to keep the service running but cannot guarantee it will always be available. If a server error affects a game, we may cancel it and return the chips involved.
5a. House players
When no other player is available, you may be matched with a house player: a computer opponent run by Fives, shown with "(House)" after its name. House players follow the same rules as everyone else, see only their own cards, and win or lose chips under the normal rules.
6. Changes and ending the service
We may change the game, its rules or prices, or these terms. If we stop offering online play, chips have no value outside the game and no refund is owed except where the law requires it.
7. Disclaimers
The game is provided "as is". To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability is limited to the amount you paid us in the 12 months before the claim.
8. App stores
If you downloaded Fives from the Apple App Store, these terms are between you and us, not Apple; Apple has no obligation to provide support or maintenance, and Apple and its subsidiaries are third-party beneficiaries of these terms. Google Play's terms also apply to downloads from Google Play.
